User Agreement

This Agreement is intended to regulate the relationship between the user and the rights holder of the internet portal darkdesert.one.

The Dark Desert project, hereinafter referred to as the 'Administration', invites you, hereinafter referred to as the 'Users', to familiarize themselves with the game and project rules.

1. General Provisions

1.1 Game Website – darkdesert.one

1.2 Operator – the rights holder of the darkdesert.one portal, is a party to the User Agreement. The Operator administers and services the portal, provides users access to the portal and services (including paid services), under the terms of this Agreement.

1.3 User – a natural person visiting the portal or participating in the projects of the darkdesert.one portal.

1.4 Portal – specialized hardware and software complexes hosted on the Operator’s resources. Access to the portal is provided only by the Operator. All rights to the use of this portal belong exclusively to the Operator.

1.5 Services – providing Users with access to the Portal, using its capabilities and services, and participating in projects under the terms specified in the Agreements. The Operator’s services are provided free of charge, except for Additional Paid Services. All Services are provided by the Operator only within the Portal, i.e., while the User is using it.

1.6 To comply with the technological process of accessing the Game, the User uses launcher.exe – auxiliary software (including security measures embedded in it) necessary for downloading/applying relevant updates to the Game Client to meet the technical parameters of the Game process.

1.7 Additional Paid Services – providing the User with additional special features of the Portal for a fee. These services are not mandatory and are provided at the User's request. Paid Services are also provided by the Operator exclusively within the Portal.

1.8 Game account, characters, items are the property of the project and do not constitute personal ownership rights.

1.9 Access to the Game process is only possible via launcher.exe.

2. Subject of the Rules

2.1 These Rules establish the conditions under which the User may use the Services for participation in the Game process.

2.2 Under these Rules, the Administration provides Users with the ability to use the Game 24/7, except for the time during maintenance and other circumstances that prevent the User from accessing the Game.

3. Additional Conditions

3.1 To properly use the Services, the User must meet the minimum system and technical requirements.

3.2 The Administration does not refund lost in-game items caused by the User losing access to their account. However, the Administration may, at its discretion, return items lost by the User due to errors, server failures, hacking, or other software malfunctions.

3.3 The Administration is not responsible for the loss of in-game items due to delayed game client updates via the updater. The User is required to update the game client through the updater to avoid errors.

3.4 The Administration does not conduct exchanges of in-game items for real money.

4. Rights and Obligations of the User

4.1 When registering, the User selects a nickname, login, and password to identify themselves among other Users. The User is required to provide the Administration with accurate Registration details.

4.2 Upon the Administration's approval, the User has the right to change their password. The User must keep their password and other necessary data confidential and is responsible for any loss or disclosure of their password, as well as any resulting risks (losses).

4.3 The User may not 'resell' the services provided by the Administration to third parties or extract any other benefit from them.

4.4 The User may not distribute information aimed at illegally obtaining access passwords to game characters, nor share links to sites with such information.

4.5 The User agrees to treat other Users and the Administration with respect and politeness.

- not to use offensive language in public game chats and forums;

— not to threaten violence and physical harm;

— not to distribute materials that promote or express hatred or intolerance toward any religion, culture, race, nationality, language, political ideology, or social movement;

— not to advertise pornographic websites, drugs, or related resources, including but not limited to: not posting materials with pornography featuring minors or ads about involving minors in such performances, not sharing information on drugs or methods of creating them, and not publishing information on suicide or promoting it.

4.6 The User is prohibited from spreading false information (rumors, slander) about the game service, the Administration, the Administration staff, and other Users. It is forbidden to use terminology in the names of game characters or guilds that implies administrative roles or to impersonate the Administration's trusted representatives.

4.7 When using the in-game chat, the User may not send identical messages repeatedly. A single identical message per minute is allowed, except for trading messages in the trade chat.

4.8 The User may not restrict access for other Users to the Game or interfere with their gameplay. Creating mechanical obstacles for others to access locations or NPCs is prohibited.

4.9 The User agrees not to transmit any information or software that contains viruses or harmful components, nor perform any actions that violate applicable laws or international regulations.

4.10 The User is prohibited from posting advertising content on the Administration's Resources.

4.11 The User may not use in-game items or advantages obtained through violations of the Rules by third parties.

4.12 It is prohibited to disclose confidential or knowingly false information about another User.

4.13 The sale, purchase, exchange, or transfer of in-game items or account access for non-game money or methods not provided by the project is prohibited.

4.14 The User is prohibited from encouraging others to perform RMT (Real Money Trading) transactions within the project, including through external resources.

4.15 Using offensive language or violating these rules in the names of characters, pets, guilds, or symbols is prohibited.

4.16 The transfer of accounts to third parties is prohibited. If a User gives their account to another person or accesses someone else's account, they will be banned along with the account owner.

4.17 Account sales (including for in-game currency) are prohibited, and transferring accounts or characters to others as gifts is also forbidden.

4.18 The use of software or devices that simulate a player's presence in the Game (such as pressing keys with objects or using specialized software) is prohibited.

4.19 The use of software that interferes with the normal operation of the server software or disrupts communication between the server and client is prohibited.

4.20 Hacking attempts, intercepting data, or circumventing limitations set by the Administration are prohibited.

4.21 The User is prohibited from exploiting server bugs or errors for personal gain and must report any server issues to the Administration immediately.

4.22 The User may receive rewards for discovering and informing the Administration about errors in the game.

4.23 The User may not conceal information about players who have exploited server bugs or violated server rules.

4.24 The User is prohibited from using non-standard fonts in technical support forum posts.

4.25 Announcing one's departure from the server or attempting to incite others to stop playing is prohibited.

4.26 The sale of guilds or territories (including for in-game currency) is prohibited.

4.27 The User is prohibited from sharing personal data of other users or game information.

4.28 The User must comply with the terms of the User Agreement. Violating the rules can lead to penalties including account blocking.

4.29 Theft (scamming) of items or assisting in theft or abusing the trust of other players for personal gain is prohibited.

4.30 Deceiving players and any fraudulent actions, including breaking agreements that may cause material or moral harm to another player, are prohibited.

4.31 The user is required to set a secure password. The responsibility for account security lies with the user. In case of theft of in-game valuables from the account, the administration may refuse to restore the items.

4.32 Intentional boosting of PvP points is prohibited. Boosting includes using alt accounts for PvP point abuse and colluding with other players to kill them for the purpose of advancing in the PvP ranking. The only exceptions are completing quests and daily tasks.

4.33 Manipulating any automated rewards, such as (but not limited to) online timers, voting rewards, event rewards, etc., is prohibited. Manipulation is defined as receiving rewards on more than two PCs simultaneously.

4.34 The sale of non-game assets for in-game currency or other means not provided by the project in the chat is prohibited.

4.35 The rights and obligations of the User apply to the game, website, forum, Vkontakte group, Facebook, Instagram, and other official pages.

4.36 Spam in trade, group requests, or friend requests to other players is prohibited, as it hinders the normal gameplay of the affected player.

4.37 Messages about selling in-game assets or recruiting for a guild, group, etc., are prohibited if such messages are not related to the server on which they are sent.

5. Operator's Rights

5.1 This Agreement grants the Operator the following rights:

— To expand, modify, suspend, or limit the provision of Services, as well as Additional Paid Services, at any time, at its discretion, without prior notice to the Users.

— To manage all processes on the Portals solely at its discretion. To suspend or modify any processes without notifying the User in advance.

— To apply sanctions to the User in case of violation of this Agreement.

— To delete or modify User's information posted on the Portals.

— To track, store identification and statistical information about the User.

— To send technical, advertising, and other information to the Users regarding the Portal, Services, and Paid Services.

— To inform, warn, issue comments, and notify the User in case of non-compliance/violation of the terms of this Agreement. All instructions from the Operator must be followed without fail.

— To take lawful measures to protect its intellectual property.

— To modify, change, or supplement the Portal at its discretion without prior notice to the User.

— The Operator's inaction regarding violations by the User of this Agreement does not exclude the application of penalties later.

— To refuse to grant a reward to a player for any promotions, tournaments, events, etc., without explanation.

5.2 Operator's Obligations

— To ensure the User can access the Operator's Services within the Portal (including Additional Paid Services).

— To respond to Users' inquiries and, in case of disputed situations, take all necessary measures to resolve them.

5.3 Limitation of Operator's Liability

— Any damage caused or that could be caused to the User's personal data and computer as a result of using the Portal and Website.

— Losses (direct/indirect) caused to the User in connection with the use or unavailability of the Portal (inability to use it), the actions of third parties on the Portal, as well as other participants in the Portal's projects, unauthorized access to the User's personal data.

— Statements, disseminated information, declarations by the User, and other unlawful actions carried out by them on the Portal and outside it.

— The information provided by the User during registration, lost access to the Portal (login, password, etc.).

— Loss of acquired virtual items by the User as a result of using the Services and Additional Paid Services provided by the Operator.

— Payment by the User for Additional Paid Services and related expenses.

— The uninterrupted operation of the Portal.

— The User's internet access capabilities and data transfer speed.

— The Operator does not guarantee:

— Continuous, reliable, error-free operation of the Portal, access to its resources, Services, including Additional Paid Services.

— That the Portal will fully meet the User's requirements and expectations.

— That the quality of the provided Services (Additional Paid Services) will meet the User's expectations.

— The Operator is not obligated to provide documents or other evidence upon the User's request to prove violations of this Agreement and the application of penalties/disciplinary sanctions against them.

— The User uses the Portal, the Operator's Website at their own risk, voluntarily, and without coercion. They understand the possible risks associated with using the Operator's resources and have no material claims against the Operator.

6. Confidentiality and Security

6.1 Confidential Information – information received by the Operator during the User's registration on the Website, as well as during visits to the Website/Portal and participation in Portal events.

6.2 Confidential information is not subject to disclosure or transfer to third parties.

6.3 Personal data may be transferred by the Operator only in the following cases:

— Official request from law enforcement authorities (violation of local and international laws).

— The User's personal request.

— The inability to use the Services and Additional Paid Services on the Portals (of which the User is warned in advance).

— Violations of this Agreement (at the Operator's discretion).

6.4 The Operator ensures the security of the User's personal data using special software. In case of unauthorized access to the Portal/Website by third parties, the security of personal data is not guaranteed.

7. Additional Paid Services

7.1 At the user's request, the operator provides Additional Paid Services. These services allow the use of extended features of the Portal.

7.2 Additional Paid Services are not a mandatory condition for using the Portal or participating in the Portal projects.

7.3 From the moment the operator deducts funds from the user's account, the additional Paid Service is considered fully rendered, of proper quality.

7.4 After the Additional Paid Service is provided, the money spent on its purchase is non-refundable.

7.5 The user agrees that the Operator has the right to store personal information obtained during the purchase of Additional Paid Services.

7.6 The list of Additional Paid Services and their prices are published only by the Operator on the Site/Portal. Any information and offers to purchase these services on third-party resources are considered fraud, for which the Operator is not responsible.

7.7 The methods and possibilities for purchasing Additional Paid Services are explained by the Operator on the Site.

7.8 The Operator does not provide explanations regarding the operation of payment systems used by the User to purchase Additional Paid Services, nor is it responsible for their correct functioning.

7.9 In case of a technical malfunction of the Sites or intentional actions by the User, or in other cases where Additional Paid Services were provided without full/partial deduction of funds from the User's account, the User must notify the Operator of this fact. After that, the User must settle the outstanding debt.

7.10 The Operator does not reimburse the User for unused (partially used) Additional Paid Services.

7.11 The User is solely responsible for all financial expenses related to the acquisition (transfer of money) of Additional Paid Services. This section includes: fees, charges, and other expenses.

7.12 The User guarantees the Operator that they have all legal authority and rights to enter into this Agreement regarding Additional Paid Services.

7.13 In the case of purchasing Additional Paid Services by a User who is under 18 years of age, they must obtain prior consent from their legal representatives for the financial transaction. The fact of purchasing Additional Paid Services is confirmation that such consent was obtained from the legal representative. If necessary, the Operator has the right to request written confirmation of the consent and provide passport data to determine the User's true age.

7.14 Responsibility for purchasing Additional Paid Services is fully assigned to the User and their legal representatives.

7.15 Disputes regarding responsibility for purchasing Additional Paid Services with the Portal Operator are not allowed.

7.16 Receiving additional Paid Services by the User is possible only after full payment of their cost.

8. Disclaimer of Warranties

- ALL SERVICES ON THE PORTAL ARE PROVIDED TO USERS UNDER THE ESTABLISHED 'AS IS' CONCEPT. THE PORTAL DISCLAIMS ANY WARRANTIES REGARDING SERVICES OR VIRTUAL ASSETS.

- THE OPERATOR HEREBY WARNES AND REMINDS THAT EXCESSIVE USE OF A COMPUTER, INCLUDING PLAYING COMPUTER GAMES, MAY BE HARMFUL TO THE USER'S HEALTH. THE USER OR THEIR LEGAL REPRESENTATIVES AGREE TO INDEPENDENTLY MONITOR THEIR HEALTH CONDITION AND NOT TO USE SERVICES / RESTRICT THEIR USE IN CASE OF ANY CONTRAINDICATIONS.

- THE OPERATOR IS NOT RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, OR OTHER DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOST PROFITS) ARISING FROM GAMING SERVICES, PORTAL SITES, AND/OR MATERIALS ON THE SITE, ACTIONS OF THIRD PARTIES RELATED TO THE SERVICES AND THE OPERATOR'S PORTAL AND/OR MATERIALS ON THE SITE, INCLUDING FRAUDULENT AND/OR NEGLIGENT ACTIONS OF THIRD PARTIES.

9. Additional Provisions

9.1 If the User is not authorized to use the Portal according to the laws of their country, or if there are other restrictions (age requirements and others), they must immediately discontinue using the Portal and its individual services without warning. The User assumes full responsibility for using the Portal in their country, based on local laws and international legislation.

9.2 The invalidity of one or more sections/clauses of the User Agreement does not affect its overall validity. In this case, the parties must fulfill their obligations under the remaining sections/clauses of the Agreement.

9.3 Disputes arising between the parties must be resolved initially through pre-trial correspondence between the Operator and the User. If mediation fails, disputes will be settled in accordance with the legislation of the Russian Federation.

9.4 This Agreement may be amended or supplemented by the Operator without prior notice to the User. Any changes take effect immediately after the publication of the amended version of the Agreement on the Site. To avoid disputes, the User agrees to independently check the text of the Agreement on the Site, where it is freely accessible. Failure to check the text of the Agreement by the User cannot serve as a basis for refusing to comply with the obligations undertaken. The amended version of the Agreement has the same legal force as the original version after its publication on the Site.

10. CONDITIONS FOR JOINING THIS AGREEMENT

10.1 Registration of an account is carried out using the Operator's Resource functionality. Before using the Game, the User must familiarize themselves with this Agreement and all applicable Game Rules and other documents, which are publicly available on the Internet at the address: darkdesert.one.

10.2 After filling in the required fields and familiarizing themselves with the Agreement, the User joins (accepts) this Agreement by clicking the 'Register' button or its equivalent, which, in accordance with Articles 435 and 438 of the Civil Code of the Russian Federation, constitutes the acceptance (offer) of the Operator and the conclusion of a contract, creating obligations for the User to comply with the terms of the Agreement, including the applicable Game Rules. The actual use of the Game also constitutes acceptance of this Agreement.

10.3 The person authorized in the Game is considered the proper user of the account, access to which has been obtained as a result of account registration, unless there is evidence to the contrary.

Privacy Policy

1. Terms Used

This Policy establishes the specifics of user data processing for the Service located at https://darkdesert.one (hereinafter referred to as the "Service") and the game servers accessible through it (hereinafter referred to as the "Servers"). This Policy also includes all applications and amendments to it.

This document (hereinafter referred to as the "Policy") is an integral part of the User Agreement.

The text of this document is posted on the website darkdesert.one.

By downloading, installing, registering, gaining access, or using the Service in any other way, you fully accept the terms of this Policy and give your explicit consent to the processing of your data in the manner and for the purposes described in this document. If you do not agree with this Policy, please refrain from downloading, installing, and using the Service in any other way.

The Service Administration has the right to periodically change and/or supplement this Policy without prior written notice to users. The new version of this document is posted at darkdesert.one. You should periodically review the changes and/or additions to it. If you continue using the Service after changes are made to this document, you confirm your agreement with the new version of the Policy.

2. Purposes of User Data Processing

Data is provided by users in connection with the conclusion of the User Agreement with the Administration located at darkdesert.one.

Data may be provided by users upon the Service's request in connection with the fulfillment of concluded agreements. Cases of data provision by the user (without limitation):

— When creating a user account on the website darkdesert.one and/or on any associated Server and managing it;

— When participating in testing additional game services and/or Service updates (if applicable);

— When participating in in-game promotions, competitions, and other similar events;

— When sending requests, letters, or making other forms of contact with the Service Administration;

— When using additional, special services within the Game.

Your data is processed for the following purposes (not limited to):

— To provide the ability to create and subsequently use and manage a user account on the Service;

— To participate in the Game and access game features defined by the game scenario;

— To interact with other users;

— To correct errors, develop new game features, and services;

— To interact with users to obtain feedback on the Service, provide user support, send notifications, and other important messages regarding the Service;

— To receive, process, and verify payments;

— To provide technical support;

— To inform users about future events related to the Service, updates, and other similar events.

3. Data About Users Collected and Processed by the Service

The data collected and processed by the Service may include (without limitation):

— Name, nickname (character's nickname);

— User identifier (login or user ID);

— Email address;

— Mobile phone number;

— Payment information, etc.

4. Other Data Collected and Processed by the Service

To provide quality services, the Service collects and processes additional non-individual data. Such data includes:

— Unique user device identifier (HWID) and software parameters;

— Operating system version, device type, and hardware identifiers;

— Time zone;

— Information about user actions on the Service and in the Game (logs of in-game actions, actions on the Service, in-game achievements, time spent in the Game, last login time, information about game logins, etc.).

The Service may collect information about your IP address and information about the geographical location of the device from which access to the Service and Servers is made, in order to provide you with services and information available for the corresponding territory in which you are located.

5. Data Storage

The data storage period is the time during which the related gaming services are provided (for the longest period), unless another period is specified by applicable law.

6. Use, Distribution, and Transfer of Data

The Service may combine (merge, integrate) and use combined user data with other information (including other data collected by the Service as defined in Section 4 of this Policy) to ensure, manage, and develop the Game.

In addition, your data may be provided in the following cases:

— When necessary to comply with the law, for example, to investigate cases of payment fraud or any other illegal activity;

— When there are reasonable suspicions of potential or existing violations of the Service's rights;

THE SERVICE ADMINISTRATION DOES NOT SHARE YOUR DATA WITH THIRD PARTIES.

7. Other Obligations of the Parties

The user is responsible for the completeness and accuracy of the data provided. In case of discrepancies and/or inaccuracies in the data provided, they must be updated, including by contacting the Service's technical support specialists, whose contact details are provided in the Support section on the Service's website — https://darkdesert.one.

The Service Administration reserves the right to store data required for compliance with applicable legislation, ensuring the safety and effectiveness of the Service and the Game when removing and/or changing user data.

8. Cookies

Cookies are small pieces of information stored in your web browser on your computer's hard drive. Like most websites, darkdesert.one uses cookies to establish a connection between you and the information you provide on our website, and thereby provide personalized content to better assist you when reusing our Services. To use such features, you must accept and allow the use of cookies.

We would like to note that if you choose not to accept cookies, you will not be able to fully use all features of our Service. By enabling cookies in your browser, you consent to the collection and processing of data as described here.

The website also uses so-called authentication cookies, which are designed to store information and data submitted by the user on the Service's websites, to avoid multiple and/or repeated submission of such data during one or more visits, in order to improve the convenience of using the Service.

Violations and Punishments on the DarkDesert Project

General Provisions

The punishments listed below, applied to the User for a specific violation, are determined at the discretion of the Administration within the limits specified in the 'Punishment' section for the corresponding violation, depending on the severity of the violation and the combination of all facts related to the violation (complaints from other Users, degree of danger, recurrence, and others). The Administration has the right to apply a more lenient punishment or reduce the duration of the specified block for the character/game account of the User. All violations listed below, committed in relation to the representatives of the Administration, may lead to permanent blocking of the game character/game account. The User is notified and agrees that when contacting the Technical Support Service in any way regarding the loss of in-game items, the Administration may impose a temporary technical block on the User's game account or accounts associated with the lost items for up to 14 days to investigate the circumstances of the loss of in-game items. A temporary technical block may also occur when investigating other violations. The Administration does not guarantee a positive outcome of the investigation. The User is notified and agrees that in-game items with a limited lifespan will not be restored after the technical block period expires, and their expiration time will not be extended due to the duration of the technical block.

Impersonating an Administrator Representative

1. Using terminology in the game character's nickname/guild name implying a connection with the Administration, including for the purpose of gaining in-game advantage and/or in-game items, such as DarkDesert, Admin, GM, etc.

Punishment: Renaming the character/guild, permanent blocking of the game account(s) of the User, returning the in-game items to the deceived owners if possible.

2. Impersonating a trusted person of the Administration and/or someone affiliated with the Administration.

Punishment: Blocking the game account(s) of the User from 1 day to permanent.

Using Profanity and Insults and/or Provocative Messages

1. Insulting a User in the game chat, including using profane language; insults/provocative messages regarding the User’s real life, family, relatives, etc., spreading confidential or knowingly false information about another User.
